In Arizona, if you are under 21, it is illegal to use a fake identification card to enter an establishment licensed to sell alcohol. It is also illegal to use false identification to induce someone to sell or give you alcohol.

What is a Fake ID?

Fake IdentificationA ‘fake ID” is a false form of identification or someone else’s identification. Typically, it is a driver license or other identification card issued by a government agency. If the card has been unlawfully altered, forged, or duplicated, it probably constitutes a “fake ID.” Additionally, if you use the valid identification card of another under the guise that it’s you, it qualifies as a “fake ID.”

Penalties For Using a Fake ID

  • A.R.S. 4-421(L): It is a class 1 misdemeanor to use a fake ID with the intent to induce someone to sell or give you alcohol.
  • A.R.S. 4-421(N): It is a class 1 misdemeanor to use a fake ID in an attempt to gain access to an establishment licensed to sell alcohol.

A class 1 misdemeanor is punishable by up to six months in jail, three years of probation, and fine of $2,500 (plus an 83% surcharge). An underage fake ID conviction has a mandatory minimum fine of $250 and will also result in a six month suspension of driving privileges.

Even if you are not convicted, the Arizona Department of Transportation may administratively suspend your driving privileges for six months if the officer had reasonable grounds to believe that you had unlawfully used a fake ID.
